These Terms of Service apply to Gesher Media LLC’s website, web pages, and all forms of media created or distributed by Gesher Media (hereinafter referred to as Services). Gesher Media LLC reserves the right to modify these Terms of Service at any time. Your continued use of this site and/or services constitutes your acceptance of such modifications. As such you should periodically review this page. If you breach any of the Terms of Service, your license to access this site and/or services will immediately terminate.

Ownership / Limited Licenses

Unless noted otherwise, all media offered for sale or use by Gesher Media, LLC, in its entirety, remains the sole property of Gesher Media, LLC and is protected by United States and international copyright, trademark, and other laws. Except as stated in these Terms of Service, no content may be copied, reproduced, distributed, republished, displayed, posted, or transmitted in any form or by any means without the prior written consent of Gesher Media, LLC. You may not use Gesher Media’s name, logo, or other trademarks for any purpose without the express written consent of Gesher Media LLC. Further restrictions govern any film media. Any rights not expressly granted herein are reserved by Gesher Media LLC.

Ownership of Photos

Photographs purchased or obtained from Gesher Media LLC may be used with the following stipulations.

A. The photographs may be used without permission for personal, non-profit, educational, or academic use.

B. The photographs may be used without permission in academic publications with acknowledgment of the source in the following manner:

C. The photographs may NOT be included in a project with a commercial end use, including most publications and websites, without the express written permission of Gesher Media LLC. Please email the company with details. Gesher Media LLC reserves the right to define commercial usage.

D. ABSOLUTELY NO RESALE OR DISTRIBUTION of photographs in any form is permitted at any time or for any reason or purpose, whether for profit (commercial use) or not for profit (private, academic, educational, etc.) use.

Ownership of Documentaries/Films

Documentaries and films purchased from/created by/produced by Gesher Media LLC may be shown in private, religious, or academic settings to groups of 30 people or less. Any showing outside these parameters without written permission by Gesher Media LLC constitutes Copyright infringement and is punishable by law.

No Refunds and Exchanges

Because of the nature of the product, Gesher Media LLC does not offer any refunds or exchanges of the purchase of photographs, documentaries, or other media

Conduct on the Services

No one will be permitted to engage in any conduct that, as determined in our sole discretion, restricts, inhibits, or interferes with the ability of Gesher Media LLC to maintain the quality and effectiveness of its business, or with the ability of any other person to use or enjoy the Services. You may use the Services only for lawful purposes. You are prohibited from: (a) accessing or using the Services to collect information about users of the Services; (b) violating or attempting to violate the security of the Services; or (c) using any device, software, or routine to interfere or attempt to interfere with the proper working of the Services or any activity conducted via the Services.

Submissions and User Content on the Services

Gesher Media may offer you the opportunity to submit comments, information, or ideas to Gesher Media or to other users of the Services (collectively “Submissions”). By sending Submissions to Gesher Media, you acknowledge that the Submissions will not be treated by Gesher Media as confidential and you agree that you grant to Gesher Media full rights to a nonexclusive, royalty-free, perpetual, irrevocable, and transferable sublicense to to use, reproduce, modify, adapt, publish, and display such Submissions throughout the world in any media for any purpose whatsoever, without restriction and without compensating you in any way. You should not send us any Submissions that you are legally prohibited from transferring to us. By sending Submissions, you warrant that you are the sole author of the content, that you are at least 18 years old, that you agree to be bound by these Terms of Service, and that your Submissions will not cause injury to the rights or property of any person or entity.

Gesher Media LLC may, but is not obligated to, monitor use of the Services and the content that you and other users may post in certain areas. We may, in our sole discretion, remove information or material that we deem to be objectionable. However, Gesher Media LLC disclaims any obligation or warranty to screen or remove objections materials.

As a user of the Services, you represent and warrant that you will not use the Services to post content or comments that is misleading or inaccurate, unrelated to the Services, or that infringes on the rights of the company or other users, that contains malicious or otherwise harmful computer code, or that otherwise violates these terms of Service.

APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OF LIABILITY SET FORTH ABOVE, SO THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. IF ANY PART OF THIS LIMITATION OF LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF GESHER MEDIA LLC UNDER SUCH CIRCUMSTANCES FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

Indemnities

You agree to hold harmless Gesher Media LLC and its respective shareholders, officers, directors, employees, or agents, from any and all claims arising out of or related to your access or use of the Services or your inability to access or to use the Services.

Applicable Law

By using the Services, you agree that the laws of the state of Texas, without regard to principles of conflict of laws, will govern these Terms of Service and any dispute of any sort that might arise between you and Gesher Media LLC.

Intellectual Property Claims

In the event of intellectual property claims by Gesher Media LLC against you, Gesher Media LLC shall have the right to litigate such claims in any state or federal court, and you consent to the exclusive and mandatory venue in such courts.

No Waiver

Gesher Media’s failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
